Privacy Policy
This Privacy Policy statement is made by the Nashville Apartment Locators (NAL) (collectively, "Nashville Apartment Locators®", "NAL","we", "us" or "our") and is effective as of 1 Jan 2022.

Privacy Commitment

‍We ask for only the least amount of information necessary, gathering only what we believe is essential for doing business or for the specific transaction at hand. We let customers know the information we have on them and allow them to opt-out of specific engagements. But, by far, our biggest commitment is that we do not make a single dollar from advertising revenue—never have. This means we avoid the fundamental conflict of interest between gathering customer information and fueling advertising revenue and the unavoidable compromises in customer privacy that it brings. The goal of this policy is to make explicit the information we gather on our customers and users, how we will use it, and how we will not. This policy is, unfortunately, longer than we would like, but we must unambiguously address all the relevant cases. We will try to keep the language as simple and direct as possible.‍

Scope of this Privacy Policy

This Privacy Policy applies to the Nashville Apartment Locators® websites. It also applies to the products and services provided by Nashville Apartment Locators® through these websites and our mobile applications. This Privacy Policy does not apply to any of our websites, products, or services with a separate privacy policy.

This Privacy Policy is divided into three parts:

Part I – Information we collect and control.

This part deals with how Nashville Apartment Locators® collects and uses information about website visitors, potential customers, users of Nashville Apartment Locators® products and services, and others who contact Nashville Apartment Locators® through forms or email addresses published on or linked to our websites.

Part II – Information that Nashville Apartment Locators® processes on your behalf.

This part deals with how Nashville Apartment Locators® handles data that you entrust to us when you use our products and services or share any personal or confidential information with us while requesting customer support.

Part III – General.

This part deals with topics relevant to both Parts I and II and other general topics such as Nashville Apartment Locators® security commitments and how we will inform you when we change this Privacy Policy.

Part I – Information Nashville Apartment Locators® collects and controls

What information does Nashville Apartment Locators® collects

We collect information about you only if we need the information for some legitimate purpose. Nashville Apartment Locators® will have information about you only if (a) you have provided the information yourself, (b) Nashville Apartment Locators® has automatically collected the information, or (c) Nashville Apartment Locators® has obtained the information from a third party. Below we describe the various scenarios that fall under each of those three categories and the information collected.

Information that you provide us

Account signup: When you sign up for an account to access one or more of our services, we ask for information like your name, contact number, email address, and country to complete the account signup process. You'll also be required to choose a unique username and password for accessing the created account. You may also provide us with more information, such as your photo, time zone, and language, but we don’t require that information to sign up for an account.

ii. Event registrations and other form submissions: We have not run any “marketing event” or “social event” to date but if we decide to do, then the information that you submit when you (i) register for any event, including webinars or seminars, (ii) subscribe to our newsletter or any other mailing list, (iii) submit a form to download any product, whitepaper, or other materials, (iv) participate in contests or respond to surveys, or (v) submit a form to request customer support or to contact Nashville Apartment Locators® for any other purpose.

iii. Payment processing: Nashville Apartment Locators® does not sell anything online; as such we do not collect any payment from you.

iv. Testimonials: When you authorize us to post testimonials about our products and services on websites, we may include your name and other personal information in the testimonial. You will be allowed to review and approve the testimonial before we post it. If you wish to update or delete your testimonial, you can contact us at info@nashapartments.com

v. Interactions with Nashville Apartment Locators®: We may record, analyze and use your interactions with us, including email, telephone, and chat conversations with our sales and customer support professionals, to improve our interactions with you and other customers.

Information that we collect automatically

i. Information from browsers, devices, and servers: When you visit our websites, we collect information that web browsers, mobile devices, and servers make available, such as the internet protocol address, browser type, language preference, time zone, referring URL, date and time of access, operating system, mobile device manufacturer and mobile network information. We include these in our log files to understand more about website visitors.

ii. Information from first-party cookies and tracking technologies: We use temporary and permanent cookies to identify users of our services and to enhance user experience. We embed unique identifiers in our downloadable products to track the usage of the products. We also use cookies, beacons, tags, scripts, and other similar technologies to identify visitors, track website navigation, gather demographic information about visitors and users, understand email campaign effectiveness, and target visitor and user engagement by tracking your activities on our websites. We only use first-party cookies and do not use third-party cookies or other third-party tracking technologies on our websites. We also use first-party Local Storage Objects (LSOs) such as HTML5 to store content information and preferences to provide certain features.

iii. Information from application logs and mobile analytics: We collect information about your use of our products, services, and mobile applications from application logs and in-house usage analytics tools and use it to understand how your business use and needs can improve our products. This information includes clicks, scrolls, features accessed, access time and frequency, errors generated, performance data, storage utilized, user settings and configurations, and devices used to access and their locations.

Information that we collect from third parties

i. Signups using federated authentication service providers: You can log in to Nashville Apartment Locators® Services using supported federated authentication service providers such as Microsoft and Google. These services will authenticate your identity and allow you to share certain personal information with us, such as your name and email address.

ii. Referrals: If someone has referred any of our products or services to you through our referral programs, that person may have provided us with your name, email address, and other personal information. You may contact us at info@nashapartments.com to request that we remove your information from our database. If you provide us information about another person, or if another person gives us your information, we will only use that information for the specific reason for which it was provided to us.

iii. Information from social media sites and other publicly available sources: When you interact or engage with us on social media sites such as Facebook, Twitter, Google+ and Instagram through posts, comments, questions and other interactions, we may collect such publicly available information, including profile information, to allow us to connect with you, improve our products, or better understand user reactions and issues. We must tell you that once collected, this information may remain with us even if you delete it from the social media sites. Nashville Apartment Locators® may also add and update information about you, from other publicly available sources.

Purposes for using information

In addition to the purposes mentioned above, we may use your information for the following purposes:

  • To communicate with you (such as through email) about products that you have downloaded and services that you have signed up for, changes to this Privacy Policy, changes to the Terms of Service, or important notices;
  • To provide customer support, and to analyze and improve our interactions with customers;
  • To detect and prevent fraudulent transactions and other illegal activities, to report spam, and to protect the rights and interests of Nashville Apartment Locators®, Nashville Apartment Locators® users, third parties and the public;
  • To update, expand and analyze our records, identify new customers, and provide products and services that may be of interest to you;

Legal bases for collecting and using information

Legal processing bases applicable to Nashville Apartment Locators®: If you are an individual from the European Economic Area (EEA), our legal basis for information collection and use depends on the personal information concerned and the context in which we collect it. Most of our information collection and processing activities are typically based on (i) contractual necessity, (ii) one or more legitimate interests of Nashville Apartment Locators® or a third party that are not overridden by your data protection interests, or (iii) your consent. Sometimes, we may be legally required to collect your information, or may need your personal information to protect your vital interests or those of another person.

Withdrawal of consent: Where we rely on your consent as the legal basis, you have the right to withdraw your consent at any time, but this will not affect any processing that has already taken place.

Legitimate interests notice: Where we rely on legitimate interests as the legal basis and those legitimate interests are not specified above, we will clearly explain to you what those legitimate interests are at the time that we collect your information.

Your choice in information use

Opt out of non-essential electronic communications: You may opt out of receiving newsletters and other non-essential messages by using the ‘unsubscribe’ function included in all such messages. However, you will continue to receive notices and essential transactional emails.

Disable cookies: You can disable browser cookies before visiting our websites. However, if you do so, you may not be able to use certain features of the websites properly.

Optional information: You can choose not to provide optional profile information such as your photo. You can also delete or change your optional profile information. You can always choose not to fill in non-mandatory fields when you submit any form linked to our websites.

Who we share your information with

Nashville Apartment Locators® is a service from Nashville Apartment Locators LLC and it has access to the information covered in Part I. We do not sell any personal information. We share your information only in the ways that are described in this Privacy Policy, and only with parties who adopt appropriate confidentiality and security measures.

Employees and independent contractors: Employees and independent contractors of all NAL  have access to the information covered in Part I on a need-to-know basis. We require all employees and independent contractors of Nashville Apartment Locators® group entities to follow this Privacy Policy for personal information that we share with them.

Third-party service providers: We do not have Third Party Service Providers

Reselling partners: We do not have any resellers

Other cases: Other scenarios in which we may share the same information covered under Parts I and II are described in Part III.

Your rights with respect to information we hold about you as a controller

If you are in the European Economic Area (EEA), you have the following rights with respect to information that Nashville Apartment Locators® holds about you. Nashville Apartment Locators® undertakes to provide you the same rights no matter where you choose to live.

Right to access: You have the right to access (and obtain a copy of, if required) the categories of personal information that we hold about you, including the information's source, purpose and period of processing, and the persons to whom the information is shared

Right to rectification: You have the right to update the information we hold about you or to rectify any inaccuracies. Based on the purpose for which we use your information, you can instruct us to add supplemental information about you in our database.

Right to erasure: You have the right to request that we delete your personal information in certain circumstances, such as when it is no longer necessary for the purpose for which it was originally collected.

Right to restriction of processing: You may also have the right to request to restrict the use of your information in certain circumstances, such as when you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Right to data portability: You have the right to transfer your information to a third party in a structured, commonly used and machine-readable format, in circumstances where the information is processed with your consent or by automated means.

Right to object: You have the right to object to using your information in certain circumstances, such as using your personal information for direct marketing.

Right to complain: You have the right to complain to the appropriate supervisory authority if you have any grievance against how we collect, use, or share your information. This right may not be available to you if there is no supervisory authority dealing with data protection in your country.

Retention of information

We retain your personal information for as long as it is required for the purposes stated in this Privacy Policy. Sometimes, we may retain your information for more extended periods as permitted or required by law, such as to maintain suppression lists, prevent abuse, if required in connection with a legal claim or proceeding, to enforce our agreements for tax, accounting, or to comply with other legal obligations. When we no longer have a legitimate need to process your information, we will delete or anonymize your information from our active databases. We will also securely store the information and isolate it from further processing on backup discs until deletion is possible.

Part II – Information that Nashville Apartment Locators® processes on your behalf

Information entrusted to Nashville Apartment Locators® and purpose.

Information provided in connection with services: You may entrust information that you or your organization (“you”) control to Nashville Apartment Locators® in connection with the use of our services or for requesting technical support for our products. This includes information regarding your customers and your employees (if you are a controller) or data that you hold and use on behalf of another person for a specific purpose, such as a customer to whom you provide services (if you are a processor). The data may either be stored on our servers when you use our services or transferred or shared with us as part of a request for technical support or other services.

Information from mobile devices: When you elect to allow it, some of our mobile applications have access to the camera, call history, contact information, photo library, and other information stored on your mobile device. Our applications require such access to provide their services. Similarly, location-based information is collected for purposes including, but not limited to, locating nearby contacts or setting location-based reminders when you elect to provide access. This information will be exclusively shared with our mapping providers and used only for mapping user locations. You may disable the mobile applications' access to this information anytime by editing the settings on your mobile device. The data stored on your mobile device and the location information to which the mobile applications have access will be used in the context of the mobile application, and transferred to and associated with your account in the corresponding services (in which case the data will be stored on our servers) or products (in which case the data will remain with you unless you share it with us).

Information from Authorized Access to Gmail or Microsoft Email: When you elect to allow it, Nashville Apartment Locators® may request optional authorization to Gmail or Microsoft Mail using OAUTH2 Access. The use of information received from Gmail APIs will adhere to Google's Limited Use Requirements. The use of information received from Microsoft APIs will adhere to Microsoft's Limited Use Requirements. As this is a voluntary integration you may disable Nashville Apartment Locators® access to Gmail or Microsoft Email any time.

(All the information entrusted to Nashville Apartment Locators® is collectively termed “service data”)

Ownership and control of your service data

We recognize that you own your service data. We provide you complete control of your service data by providing you the ability to (i) access your service data, (ii) share your service data through supported third-party integrations, and (iii) request export or deletion of your service data.

How we use service data

We process your service data when you provide us instructions through the various modules of our services. For example, when you generate an sales order, information such as the name and address of your customer will be used to generate the sales order; and when you use our campaign management service for email marketing, the email addresses of the persons on your mailing list will be used for sending the emails.

Push notifications

If you have enabled notification on our desktop and mobile applications, we will push notifications through a push notification provider such as Apple Push Notification Service, Google Cloud Messaging or Windows Push Notification Services. You can manage your push notification preferences or deactivate these notifications by turning off notifications in the application or device settings.

Who we share service data with

Employees and independent contractors: We may provide access to your service data to our employees and individuals who are independent contractors of the NAL involved in providing the services (collectively our “employees”) so that they can (i) identify, analyze and resolve errors, (ii) manually verify emails reported as spam to improve spam detection, or (iii) manually verify scanned images that you submit to us to verify the accuracy of optical character recognition. We ensure that access by our employees to your service data is restricted to specific individuals, and is logged and audited. Our employees will also have access to data that you knowingly share with us for technical support or to import data into our products or services. We communicate our privacy and security guidelines to our employees and strictly enforce privacy safeguards within NAL.

Collaborators and other users: Some of our products or services allow you to collaborate with other users or third parties. Initiating collaboration may enable other collaborators to view some or all of your profile information. For example, when you edit a document you have shared with other persons for collaboration, your name and profile picture will be displayed next to your edits to let your collaborators know that you made those edits.

Third-party integrations you have enabled: Some of our products and services support integrations with third-party products and services. If you choose to enable any third-party integrations, you may allow the third party to access your service information and personal information about you. We encourage you to review the privacy practices of the third-party services and products before you enable integrations with them.

Other cases: Other scenarios in which we may share information that is common to information covered under Parts I and II are described in Part III.

Retention of information

We hold the data in your account as long as you use Nashville Apartment Locators® Services. Once you terminate your Nashville Apartment Locators® user account, your data will eventually get deleted from the active database during the next clean-up that occurs once in 6 months. The data deleted from the active database will be deleted from backups after three months.

Data subject requests

If you are from the European Economic Area and you believe that we store, use or process your information on behalf of one of our customers, please get in touch with the customer if you would like to access, rectify, erase, restrict or object to processing, or export your personal data. We will extend our support to our customer in responding to your request within a reasonable timeframe.

Part III – General

Children’s personal information

Our products and services are not directed to individuals under 16. Nashville Apartment Locators® does not knowingly collect personal information from children under 16 years of age. If we become aware that a child under 16 has provided us with personal information, we will take steps to delete such information. If you believe that a child under 16 years has provided personal information to us, please write to info@nashapartments.com with the details, and we will take the necessary steps to delete the information we hold about that child.

Data Protection Officer

We have appointed a Data Protection Officer to oversee our management of your personal information in accordance with this Privacy Policy. Locations and international transfers

We share your personal information and service data within the NAL. We do not have International offices, and we are located in the USA at one location (Nashville, TN). By accessing or using our products and services or otherwise providing personal information or service data to us, you consent to the processing, transfer, and storage of your personal information or Service Data within the United States of America, the European Economic Area (EEA) and other countries where Nashville Apartment Locators® operates. Such transfer is subject to a group company agreement based on EU Commission’s Model Contractual Clauses.

Data processing addendum

To enable you to comply with the data protection obligations under the General Data Protection Regulation, we are prepared to sign a Data Processing Addendum (DPA) based on Standard Contractual Clauses. You can request a DPA from Nashville Apartment Locators® by writing to info@nashapartments.com. Once we get your request, we'll forward the DPA to you for your signature.

Do Not Track (DNT) requests.

Some internet browsers have enabled 'Do Not Track' (DNT) features, which send out a signal (called the DNT signal) to the websites you visit, indicating that you don't wish to be tracked. Currently, there is no standard that governs what websites can or should do when they receive these signals. For now, we do not take action in response to these signals.

External links on our websites

Some pages of our websites may contain links to websites that are not linked to this Privacy Policy. If you submit your personal information to any of these third-party sites, their privacy policies govern your personal information. As a safety measure, we recommend that you not share personal information with these third parties unless you've checked their privacy policies and assured yourself of their privacy practices.

Blogs and forums

We offer publicly accessible blogs and forums on our websites. Please be aware that any information you provide on these blogs and forums may be used to contact you with unsolicited messages. We urge you to be cautious in disclosing personal information in our blogs and forums. Nashville Apartment Locators® is not responsible for the personal information you elect to disclose publicly. Your posts and certain profile information may remain even after you terminate your account with Nashville Apartment Locators®. To request the removal of your information from our blogs and forums, you can contact us at info@nashapartments.com.

Social media widgets

Our websites include social media widgets such as Facebook "like" buttons and Twitter "tweet" buttons that let you share articles and other information. These widgets may collect information such as your IP address and the pages you navigate on the website and may set a cookie to enable the widgets to function properly. Your interactions with these widgets are governed by the privacy policies of the companies providing them.

Disclosures in compliance with legal obligations

We may be required by law to preserve or disclose your personal information and service data to comply with any applicable law, regulation, legal process, or governmental request, including to meet national security requirements.

Enforcement of our rights

We may disclose personal information and service data to a third party if we believe that such disclosure is necessary for preventing fraud, investigating any suspected illegal activity, enforcing our agreements or policies, or protecting the safety of our users.

Business Transfers

We do not intend to sell our business. However, in the unlikely event that we sell our business or get acquired or merged, we will ensure that the acquiring entity is legally bound to honor our commitments to you. We will notify you via email or through a prominent notice on our website of any change in ownership or the use of your personal information and service data. We will also notify you about your choices regarding your personal information and service data.

Compliance with this Privacy Policy

We make every effort, including periodic reviews, to ensure that personal information you provide is used in conformity with this Privacy Policy. We'll contact you and, if required, coordinate with the appropriate regulatory authorities to effectively address your concerns.

Notification of changes

We may modify the Privacy Policy at any time, upon notifying you through a service announcement or by sending an email to your primary email address. If we make significant changes to the Privacy Policy that affect your rights, you will be provided at least 30 days' advance notice of the changes via email to your primary email address. If you think the updated Privacy Policy affects your rights regarding your use of our products or services, you may terminate your use by sending us an email within 30 days. Your continued use after the effective date of changes to the Privacy Policy will be deemed your agreement to the modified Privacy Policy. You will not receive email notification of minor changes to the Privacy Policy. Terms of Use
Nashville Apartment Locators, LLC. (referred to herein as the “NAL,” “we,” “our,” or “us”) provides an informational website for residents and prospective residents (“you”) who wish to gain information about residential properties (each a “Property”) and related products and services (“Services”).  These Terms of Use (“Terms”) describes our policies and practices while you are using our website, www.nashvilleapartmentlocators.com, and associated websites, as well as those who interact with Us via our social media pages and mobile applications (collectively, the “Site”)

BY AGREEING TO USE OUR SITE, YOU REPRESENT AND WARRANT THAT YOU ARE AT LEAST EIGHTEEN (18) YEARS OF AGE, AND YOU UNDERSTAND AND AGREE THAT THIS AGREEMENT GOVERNS ANY USE OF THE SITE BY YOU.

1.  Notice. The Site is owned and operated by Us and its contractors.  We have the right at any time to change or discontinue any aspect or feature of the Site, including, without limitation, the contents of the Site and any services offered by the Site.  You may visit our Site at any time to read these Terms and learn of any revisions made to these Terms.  All such changes are binding on you 14 calendar days after they are initially posted on the Site unless you are a new user, in which case they are binding on you immediately.

2.  Intended Use.

a. This site offers general information about apartment location services. It uses the information that you provide to put you in touch with our agents and/or brokers and potential apartment communities.  Our company includes agents and brokers licensed in the State of Tennessee; accordingly, we are governed by all rules and regulations of that profession.  Your submission of information does not automatically create a brokerage relationship with us or any particular broker/agent

b. You understand that we do not accept any liability whatsoever for any harm that might result from any statements presented on the Site, including any descriptions of the Properties, Services, or any third-party services or products posted on or offered through our Site.

c. You understand that any statements by us and/or employees, agents, affiliates, and members are provided only for informational purposes.

3.  Our Services.

a. In General. We offer information to tenants and prospective tenants regarding various Property spaces and amenities, as well as specific events, policies, and financial, logistical, and operational matters.  Your use of the Site does not create a landlord-tenant relationship, nor does it constitute an offer to lease any Property.  All leasing decisions are between you and each Property, completely exclusive of us.  

4. Use of Information and Materials on our Site.

a. The information contained on our Site is subject to change without notice.

b. While we make every effort to ensure that the information on our Site is accurate, we make no representations or warranties regarding the accuracy or reliability of any information provided on our Site.

c. Any unauthorized use of our Site and systems, including, but not limited to, unauthorized entry into our system, misuse of passwords, or misuse of any information posted on our Site, is strictly prohibited.

d. Except as expressly granted herein, the viewing, printing, or downloading of any content, graphic, form, or document from the Site, is prohibited.  We grant you only a limited, nonexclusive license for the use of such materials solely by you for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works, or other use.

e. Prohibitions:  You are prohibited from using this site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others, to the extent the same may exist; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of our services or site; (h) to collect or track the personal information of others; (i) to spam, phish, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of our services or site. We reserve the right to terminate your use of our services or site for violating any prohibited uses.

5. Third Party Links/Services

For the convenience and benefit of our clients and prospective clients, we will, from time to time, engage various third-party service providers (collectively, “Vendors”) to provide certain services (other than the Services) such as application processing, background and credit screening, utilities transfer/connection, moving, resident account management, and other services (collectively, “Tenant Services”) which are accessible via links from the Site. Although Tenant Services may be “white labeled” with our name and branding and/or email addresses and phone numbers, such Tenant Services are managed exclusively by the Vendors.  To use Tenant Services and access Vendor systems, you may be required to set up an account and provide various personal and financial information to the Vendor.  Please note that your use of Tenant Services will be subject to each Vendor’s terms and privacy policies – not ours.   These Terms apply solely to our Site and do not apply to Tenant Services and/or any other websites to which we may provide links.  We are not responsible for the content, accuracy, or opinions expressed in such linked Vendors or websites, and the inclusion of such links on our Site does not imply our approval or endorsement of such websites.  Please be aware that we are not responsible for and cannot control Vendors' terms of use, privacy policies, conditions, or other websites.  We encourage you to be aware of when you leave our Site (i.e., whenever you are required to register or login) and to read the Vendor terms of use and privacy policy of each Tenant Service and another website you access and use.

6. Privacy.

a. Policy. By using the Site, you also agree to the privacy standards we set. Our Privacy Policy is incorporated into these Terms by reference.

b. Disclaimer.  We cannot ensure that all of your private communications and other personal information will never be disclosed in ways not otherwise described in these Terms.  By way of example (without limiting the preceding), we may be forced to disclose personal information to the government or third parties under certain circumstances, third parties may unlawfully intercept or access transmission or private communications, or users may abuse or misuse your personal information that they collect from our Site.

7. Enforcement.

a. Limitations of Warranties and Remedies. To the full extent allowed by law, we disclaim all warranties, terms, or conditions, express or implied, either in fact or by operation of law, statutory or otherwise, including warranties, terms, or conditions of merchantability and fitness for a particular purpose.  We neither assume nor authorize any other person to assume any further liability for the sale and use of the Services or services provided by Property or any third party.  In no event will we be liable for any incidental, consequential, punitive, or special damages, including, without limitation, lost profits or revenues, even if we have, or should have had, any knowledge, actual or constructive, of the possibility of such damages.

b. Limitation of Liability.  To the greatest extent authorized by applicable law, in no event shall we, our directors, officers, employees, affiliates, agents, or service providers be liable for any injury, loss, claim, or any damages of any kind, including whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of this site, or for any other claim related in any way to your use of this site, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the site or any content transmitted or otherwise made available via the site, even if advised of their possibility; this also includes any damage or harm that you may suffer from actually residing in any apartment community after utilizing any services we offer on the site, such liability being expressly denied.

Unless otherwise noted, all Tenant Services and any other services (other than the Services as defined above) are provided by independent Vendors and not by us. In no event will we be liable for any Tenant Services, other services, nor any act or omission by any Vendor, including (without limitation) those who are “White labeled” with our name and brands and/or email addresses.  Each Vendor is an independent service provider, not a partner or affiliate.

c. Indemnification.  You agree to defend, indemnify, and hold harmless us and our officers, directors, contractors, owners, agents, and employees (the “Covered Parties”) against any third-party claims, suits, costs, losses, liabilities, and expenses of any kind (including reasonable attorneys’ fees) that the Covered Parties may incur arising out of or resulting from your use of the Site or any of the Services.

d. Choice of Law and Venue.  These Terms will be construed and governed by the laws of the State of Tennessee without the application of choice-of-law provisions that would require the application of the laws of another jurisdiction.  By using the Site, you hereby irrevocably submit yourself to the exclusive venue and personal jurisdiction of the state and federal courts in Davidson County, Tennessee, concerning any dispute relating to these Terms or its enforcement.  You also, with this, waive any challenge to venue and personal jurisdiction you may have to a lawsuit filed in a state or federal court in Davidson County, Tennessee, relating to a dispute between the parties relating to these Terms or its enforcement.

e. Severability.  If any provision of these Terms are found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of any of the remaining provisions will not in any way be affected or impaired, and a valid, legal, and enforceable provision of similar intent and economic impact will be substituted therefore.

f. Additional Provisions Regarding Liability.  You agree that the previous limitations will not be read to limit any liability to the extent that would not be permitted under applicable law and, specifically, will not limit any liability for gross negligence, intentional, tortious, or unlawful conduct or damages for strict liability that may not be limited by law.

g. Notices.  Any notices or communication you send to us pursuant to these Terms will be in writing and sent to the address specified herein or such other address as Property may specify in writing.  All notices must be sent to: legal@nashapartments.com.

8. Additional Information.

a. Trademarks.  We are the owner of the marks “Nashville Apartment Locators” and all related marks, slogans, and logos appearing on the Site. We have been operating under the name “Apartment Locators” since 2018 and that term is also registered with the licensing department. All Property and other marks and logos appearing on the Site are owned by their respective owners. We are the owner of the Site, including the overall look and feel, page headers, design properties, distinctive color combinations, typography, graphic designs, graphical user interfaces, data displays, button icons, and imagery.    All rights are reserved.

b. Copyrights.  Our Site contains copyrighted material and other proprietary information, including, without limitation, downloadable files, text, charts, reports, data displays, software, graphical user interfaces, icons, photos, video, and graphics.  The Site's contents are protected under the United States and foreign country copyright laws and international treaties.  You may not modify, publish, transmit, display, participate in the transfer or sale, create derivative works, or in any way exploit any of the Site’s content, in whole or in part.  No copying, redistribution, retransmission, publication, or commercial exploitation of downloadable material will be permitted without the express written permission of Property and the copyright owner, if applicable.  All rights are reserved.

9. Suggestions and Idea Submissions.  Unless otherwise agreed to in writing, we do not accept unauthorized idea submissions outside established business relationships.  To protect the interests of our current partners and ourselves, we must treat the issue of such submissions with great care.  Importantly, without a clear business relationship, we cannot and do not treat any such submissions in confidence.  Accordingly, please do not communicate unauthorized idea submissions with us through the Site.  Any ideas disclosed to us outside of a pre-existing and documented confidential business relationship are not confidential. We may therefore develop, use, and freely disclose or publish similar ideas without compensating you or accounting to you.  We will make every reasonable effort to return or destroy any unauthorized idea submissions without a detailed review.  However, if, in our sole discretion, we determine that a review is necessary, it will be with the understanding that we assume no obligation to protect the confidentiality of your idea or compensate you for its disclosure or use.  By submitting an idea or other detailed submission to us through the Site, you agree to be bound by these terms.

Representations and Warranties.  By using the Site, you represent and warrant that you are using the Site solely for personal reasons and that you are not an attorney or an agent of an attorney investigating a potential claim related to the Site, any materials available through the Site, or us.  You also represent and warrant that you are not engaging in activities in an attempt to circumvent, or make any efforts to it, any encryption, password protection, or security features placed within the Site or any subpart thereof, or reverse engineer any part of the Site, portions of the Site, or any materials available through the Site.  You also represent and warrant that any information you provide us is true and accurate.
